Attorney Sanctioned for Fake Cases Generated by AI

A recent Michigan Court of Appeals Opinion affirmed a trial court’s decision denying plaintiff’s motion for new trial or evidentiary hearing partly because plaintiff’s counsel repeatedly relied upon fabricated and unsupported legal authority which was generated by AI.

Instead, the court held that “counsel’s repeated submission of fabricated and unsupported authority grossly disregarded the requirements of fair presentation and violated the duty of reasonable inquiry, [the court of appeals] remand[ed] for a determination of the actual damages and expenses that defendant incurred because of [the] appeal” which was ordered payable “by plaintiff’s counsel personally.”

This case represents yet another warning to attorneys that if they are using AI, they better make sure that the legal authority they are citing actually exists and applies to the case.
